Migration policies and mobility control have become key electoral issues. Since 1993 and the Pasqua Laws, conditions of entry and residence in France have been tightened for foreigners: obstacles to the regularization of illegal migrants have multiplied. Confronted with the ongoing and long lasting issue of undocumented migrants, governements find it difficult to offer an answer that is both sustainable and compatible with certain fundamental rights. Yet it is the future of democracy itself that is at stake. Two years after Lionel Jospin's government had promulgated the circulaire Chevènement, on 24 June 1997, which adds restrictive measures to previous legislation, the authors offer a critical analysis of French migration policies and question the existing alternatives, both at a Europen and at a national level, to closing the borders.
